You can prepare documents and check tax conditions now, but the pre-filled PIT-37 for 2026 income must not be treated as already available. On 22.10.2026, the next filing season is still ahead. An official form and a person’s prepared return in Twój e-PIT are different things: availability of the former does not establish availability of the latter.

The Ministry already lists PIT-37(31) for 2025 and 2026. This is a confirmed starting point, not permission to describe last year’s interface as an exact guide to the coming season. Before submission, check the applicable form, KAS guidance and your circumstances.

The main task for a foreign taxpayer is not simply finding a submit button. Establish residence, select the right return, collect every payer’s information, check costs and reliefs, then retain acceptance evidence. If you worked abroad or ran a business, the prepared PIT-37 may cover only part of the picture or be the wrong form altogether.

Who can use PIT-37, and who needs another route?

PIT-37 generally covers scale-taxed income handled during the year by Polish tax withholding agents, such as wages and qualifying umowa zlecenie payments. The payer withholds advances and supplies information; the taxpayer establishes the final annual liability. This explains why amounts withheld do not always equal the final tax.

Foreign citizenship does not itself prevent using PIT-37. Nor does it mean every contract and payment belongs there. Certain non-resident civil-contract income may have a different treatment and IFT-1/IFT-1R information. Do not turn it into an ordinary PIT-11 because friends filed PIT-37.

The short PIT-11 checklist helps check payer information. This guide prepares the complete annual assessment. Business activity, property sales, investments and other separate income require their own assessment.

Income and how it was received determine the form
Situation Usual route Qualification
Wages/qualifying zlecenie through withholding agents PIT-37 if its conditions are met Collect every payer, not just the main job
Scale income without a Polish withholding agent, relevant business/foreign work PIT-36 and PIT/ZG where required Check residence and treaty, not every foreign transfer automatically
Ryczałt income, including qualifying private rental PIT-28 May be filed separately from employment income
Flat-rate business income tax PIT-36L Not replaced by employment PIT-37
Capital income or property sales Separate applicable forms Do not fit all income into a wage field

Residence: a residence card and 183 days are not the whole test

Under Article 3 of the PIT Act, Polish tax residence can arise from a centre of personal or economic interests in Poland or a stay exceeding 183 days in the tax year. These are alternative tests, not two conditions that must always be met together. A person arriving late in the year still needs to assess their centre of interests.

A resident generally considers worldwide income subject to treaty rules; a non-resident considers relevant Polish income. Nationality, UKR status and a plastic card’s validity do not replace that assessment. If both countries claim residence, apply the relevant treaty’s ordered tests, including a permanent home, vital interests and other prescribed criteria.

Keep a presence calendar and facts about family, employment, housing and economic activity. Registered address alone does not decide the issue, nor does a foreign bank account. Changes during the year may require separate period analysis. Do not sign an untrue residence declaration for the employer merely to obtain more convenient withholding.

When to file for 2026, and what is already confirmed

The current general Article 45 window is from 15 February to 30 April of the following year. For 2026 income, this is 15.02.2027–30.04.2027 unless later legislation changes it. A return submitted before the statutory window is treated as submitted on 15 February; that does not mean the online 2026 return is open in October.

Publication of form (31), access to e-Urząd Skarbowy and a familiar previous-season screen do not establish launch of the next season. Exact button labels, automatic-acceptance settings and new 2027 instructions must be checked after official opening. This describes the ordinary process without invented future screenshots.

You need not file in the first hour of 15 February. Obtaining all relevant information and checking it before the deadline is more useful. The PIT-11 recipient deadline and Twój e-PIT opening are different dates: an early prepared return may not yet reflect every actual circumstance or correction.

PIT-11: collect all payers and the latest corrections

PIT-11 is the payer’s information about income, costs, advances and other amounts, not your final return. Employees with several jobs or a job change collect information from each payer. A single employer may make different payment types; check individual fields as well as the total.

The general transmission schedule is the end of January to the tax authority and the end of February to the recipient in the following year, with applicable non-working-day adjustments. KAS payer guidance distinguishes these deadlines. The document is not overdue merely because your employer has not sent your copy on 15 February.

Check PESEL/NIP, name, year, payer, payslip amounts and reliefs applied. If a corrected PIT-11 arrives for the same period, establish what it replaces: adding the original and its correction as independent income is wrong. Keep both for history, but prepare the assessment from correct figures.

If PIT-11 is missing, request it in writing and reconstruct information from payslips, contracts and payments. Missing information does not automatically remove the filing obligation or permit invented figures. The official missing-PIT-11 guide explains the route. For a material discrepancy, contact KAS before the deadline.

Preparation folder: what to collect before February

  1. Establish tax residence and every income source, including foreign work, business and rental.
  2. Collect PIT-11/PIT-11A and other applicable payer information, latest corrections and your payslips.
  3. Check your PESEL or appropriate NIP, current details, address and refund account.
  4. Prepare evidence for actual costs and reliefs: children, marriage, an adult child’s studies and other required confirmations.
  5. Check your own official e-Urząd Skarbowy access and a suitable login method without giving an intermediary your password.
  6. After opening, choose the right year and form, compare every line, submit and save UPO with accepted status.

For an ordinary individual without business or another NIP basis, PESEL is normally the tax identifier. NIP is not a universal alternative for every foreigner. If you lack a number, establish the PESEL-for-tax route at the municipality or the proper procedure for your case. Someone else’s number or a technical repeated-digit placeholder does not make the return correct.

After changing surname, document or address, reconcile employer and tax records. Updating a refund account and obtaining the tax micro-account for payments are different tasks. The refund account must belong to an eligible recipient; do not insert an intermediary’s bank details simply because they helped complete the form.

How Twój e-PIT normally works

Enter through the official e-Urząd Skarbowy, not an advertisement with a similar name. State-supported identification methods are available; verify the next season’s actual options and screen. Profil zaufany is a login method, not a separate tax return. See the trusted-profile checklist for arranging it.

After launch, select income year 2026 and check prepared payers, income, costs, advances, exemptions, assessment method and attachments. Do not repeat a family relief automatically from last year: the child’s age, education, income and allocation between parents may have changed. Check the account and refund method separately.

Correct incomplete or wrong information using the appropriate form. Do not insert foreign earnings into an arbitrary PIT-37 field just to avoid PIT-36. Using the same electronic service does not make different tax forms interchangeable.

Submission ends with an accepted return and UPO, Urzędowe Poświadczenie Odbioru. A screenshot of completed fields or a saved draft is not evidence of filing. Retain the complete submitted return, attachments and acknowledgement so you can establish what was accepted rather than remember a green button.

Automatic acceptance is not a substitute for checking

Under the ordinary current mechanism, certain prepared PIT-37 and PIT-38 returns can be automatically accepted at the deadline if the taxpayer has not taken another prescribed action. This is not universal for all forms and people: PIT-36 and PIT-28 must not be treated as automatically completed in the same way.

Some situations, including only particular exempt income, have exceptions. Waiting until the end of April does not fix omitted foreign earnings, a missing relief or wrong residence. The official forms FAQ describes the current mechanism; the 2027 season’s rules require fresh verification.

Even an automatically accepted return can show tax due. Filing confirmation and payment are different. If using another form or joint assessment, arrange it correctly rather than creating several competing initial returns for the same income.

Income, costs and tax base: gross wages are not tax

Employment income generally depends on when money is received or made available, not only the month it was earned for. Ordinary December wages paid in January of the next year require the appropriate year under the applicable rule. Do not move them backwards solely because of a payslip’s month label.

Przychód is revenue before prescribed reductions; koszty uzyskania przychodu reduce it under their own rules, followed by allowable deductions. The tax bases in the examples below have already been established after applicable reductions. You cannot simply subtract 30000 from any bank receipt to obtain a complete payment calculation.

Ordinary employment costs currently amount to 250 PLN monthly and a 3000 PLN annual cap for one employment relationship. Qualifying residence outside the workplace’s town, subject to conditions, allows 300 PLN and 3600 PLN. Multiple employment relationships can have annual caps of 4500 or 5400 PLN; do not add every PIT-11 cost figure without checking.

Zlecenie has different rules, often 20% of the prescribed base after attributable social contributions, not the employment 250 PLN. Copyright costs of 50% do not arise merely from the job title “programmer”: legal conditions and records are needed. Rent, food and every taxi trip do not automatically become employee deductions. KAS publishes the 2026 scale and costs.

The 2026 scale: 32% applies only to the excess

Scale for an already established annual tax base
Base Rule Consequence
Up to 30000 PLN Tax-free amount within the scale Not a separate allowance for every job
Up to 120000 PLN 12% of the base minus 3600 PLN, subject to the applicable minimum Not 12% of any gross salary
Above 120000 PLN 10800 PLN +32% of the excess over 120000 PLN The higher rate does not cover the entire base

The 30000 PLN tax-free amount belongs to the annual scale assessment. Two jobs do not create a 60000 PLN exemption, and separate payers’ withholding can produce tax due. Check the combined calculation even when individual payslips each appear correct.

32% applies to the part above the threshold, not every złoty after crossing it. Annual tax liability and advances withheld are separate amounts. A refund follows their comparison with applicable reliefs, not foreign citizenship or parenthood alone.

Child relief: a tax deduction, not 800+

Ulga na dzieci reduces tax when parental authority, guardianship or support conditions are met for an eligible child. It is not another 800+ benefit, and receiving family support does not establish all tax criteria. You need child details, eligible months and allocation between entitled adults.

The current monthly amounts are 92,67 PLN for the first and second child, 166,67 PLN for the third, and 225 PLN for the fourth and subsequent children. Full-year amounts are respectively 1112,04;1112,04;2000,04;2700 PLN. Both parents cannot each claim the full shared deduction for the same child and period: agree allocation under the rules.

For one eligible child, parental-income limits are 112000 PLN in the specified married case and for an eligible single parent, or 56000 PLN in the prescribed unmarried case. A specified child disability has an exception. Several children in a household do not always mean several simultaneously eligible children for relief.

For an adult student under 25, studies and specified income/exempt receipts are checked; the current official page states a 2026 limit of 23741,88 PLN. This is not a universal threshold for every minor, and social contributions must not be deducted arbitrarily from the tested figure. Special disability grounds are assessed separately.

Claim through the PIT/O attachment. If tax is insufficient, the additional refund depends on statutory contribution limits, not automatically the entire attractive headline amount. The current KAS guidance was updated on 13.10.2026. Keep evidence of age, authority, education and income where required.

Young workers and joint assessment for spouses

Ulga dla młodych covers specified income before age 26 within an annual 85528 PLN limit. Income type and payment date matter, including the relevant birthday under current rules. Not every zlecenie, business receipt or ZUS payment qualifies; the exemption cannot automatically cover every sickness payment.

The cap is shared across specified combined exemptions, not renewed for every employer. Taxable excess follows the scale rules; this does not imply a refund of every insurance contribution. The official youth-relief guide separates tax from insurance and lists qualifying sources.

Joint assessment requires marriage and marital community of property during the prescribed period, eligible residence and no disqualifying circumstances. Marriage during the year can qualify if conditions continue until year-end; “a full year of marriage is always required” is outdated. But a shared Polish address or a spouse’s zero wages alone does not prove eligibility.

Certain EU/EEA/Swiss residence cases have a special route requiring at least 75% of relevant combined revenue in Poland and a residence certificate. This is not universal for every couple with a spouse abroad. Business tax regimes also require checking exclusions. Under the joint-assessment rules, combine eligible bases after each spouse’s deductions, divide by 2, apply the scale and multiply by 2.

Foreign income: workplace and bank transfers are different

If you worked outside Poland, establish residence, the country of physical work, the relevant treaty and effective MLI changes first. Exemption with progression and proportional credit create different obligations. “Tax was withheld abroad, so nothing is needed in Poland” cannot be promised without that assessment.

Relevant cases use PIT-36 with PIT/ZG rather than putting foreign wages into an arbitrary PIT-37 section. Certain exempt foreign-only income may not require a Polish return, while combining income can change the result. Residence and treaty method matter more than a passport.

A foreign employer does not always mean work abroad: remote work physically performed in Poland needs separate assessment, including the absence of a Polish withholding agent. Foreign currency follows prescribed NBP conversion rules, normally the last working day before receipt, not a random bank-conversion rate. Retain payment dates and original currency.

KAS explains foreign earnings. Moving previously accumulated money to your own account does not itself create new wages, but a transfer label cannot change the nature of actual income. See the separate money-transfer guide for banking arrangements.

Three verifiable calculations without invented take-home pay

Each example starts with an established annual taxable base after eligible costs and deductions. It does not calculate contributions from an arbitrary gross wage, special exemptions or child relief. The figures illustrate current-scale arithmetic, not an individual tax return.

Conditional figures and checks
Example Tax calculation Comparison
Base 60000 PLN; advances 6000 PLN 60000 ×12% −3600 =3600 PLN Overpayment 6000 −3600 =2400 PLN
Base 150000 PLN; advances 18000 PLN 10800 + (150000 −120000) ×32% =20400 PLN Tax due 20400 −18000 =2400 PLN
Eligible joint assessment: bases 120000 and 0 PLN (120000 +0) /2 =60000; tax 3600 ×2 =7200 PLN Separate tax on 120000:10800 PLN; difference 3600 PLN

The first refund follows excessive advances, not a special foreigner’s allowance. In the second, crossing the threshold raises tax only on the relevant part. The third requires an existing right to joint assessment: favourable arithmetic does not replace marriage, property, residence and tax-regime conditions.

In practice, compare the result with advances and reliefs already used, then check rounding and attachments. One example is not a calculator for every family: identical receipts can have different costs, exemptions and legal bases.

Refund timing and paying tax due

Under current rules, the ordinary maximum refund period is 45 days for an electronic return and 3 months for paper. Timing follows submission under the applicable rules; sending before the season does not promise a January refund. Correction, checks and debt offsets can affect the practical outcome.

KAS explains refund periods. Check that an appropriate account of your own is recorded. Do not respond to a text message offering to activate a refund by providing card details or entering your bank through an unfamiliar window.

If tax is due, the ordinary deadline is the end of the statutory filing period, not when you finally read an automatically accepted return. Use the correct official tax micro-account and payment reference. If unable to pay on time, apply for the prescribed decision rather than assuming instalments are automatic.

Korekta: correcting an accepted return

Correct the proper year and form, selecting korekta zeznania. Submit the complete correct assessment, not only the difference in one field. Check attachments and retain a new acceptance acknowledgement. An employer’s corrected PIT-11 does not mean your submitted return always updates automatically.

If an error creates more tax due, assess payment and possible interest separately; correcting text does not clear a debt. Where no initial return was filed, an ordinary correction may be inappropriate: submit the proper original and address lateness. Do not apply a template czynny żal to every case without assessment.

For disputed foreign-income treatment or a wrong form, prompt KAS or professional tax advice is more useful than several incompatible returns. Keep versions and the reason for changes in your records; the original UPO remains evidence of the case history.

Six situations for foreign taxpayers

These scenarios are hypothetical; confirmed circumstances determine the result.

Two jobs during the year

Collect both payers and their latest corrections. Check combined annual costs and the tax-free amount without doubling them for two contracts. A prepared return from only the new job does not erase earlier wages.

Arriving with the family in autumn

Do not determine residence only from days remaining in the year. Check the centre of interests, previous country and treaty. These establish relevant income and forms before PIT-37 is accepted.

A worker is still under 26

Check income type, payment dates and the combined exemption limit, with insurance separately. Sickness benefit or business income is not automatically exempt because of age. Any additional child-relief refund has its own limits.

A spouse had no work

Check joint-assessment conditions first, including residence and property. A zero base can produce the example’s benefit but cannot create eligibility. A prepared individual return does not replace the selected joint assessment.

Wages were earned abroad

Establish physical workplace, residence, treaty method and PIT-36/PIT/ZG requirements. Do not hide the amount in bank history or assume foreign withholding completed the Polish obligation.

A corrected PIT-11 arrives after submission

Compare it with the accepted return, correct where needed and check payment and refund timing. Do not add original and corrected information as two incomes; retain acknowledgements for history.

A Polish request about PIT-11

[data, podpis].

Specify the actual discrepancy and a safe reply channel. Do not send a full PESEL and all financial records to several unknown intermediaries. A request does not replace your return or extend the statutory deadline.

Common mistakes

  • Treating 2026 income as an already-open 2027 season.
  • Confusing published form (31) with an available pre-filled return.
  • Treating a residence card or fewer than 183 days as a final residence answer.
  • Omitting a payer or adding original PIT-11 and its correction.
  • Doubling allowances and costs for two jobs.
  • Charging 32% on the whole base rather than excess.
  • Assuming 800+ gives the full child tax deduction.
  • Extending youth relief to every income and contribution.
  • Omitting foreign work or choosing PIT-37 for a business without checking.
  • Saving a draft instead of an accepted return and UPO.

FAQ

Can I submit PIT-37 for 2026 already?

On 22.10.2026 the 2027 season is not open. Prepare documents now; the ordinary statutory period is 15.02–30.04.2027 unless later changes apply.

Has no 2026 form been published?

The Ministry already lists PIT-37(31) for 2025 and 2026. This does not establish availability of the prepared return or final next-season interface.

Does every foreigner need NIP?

No. PESEL normally applies to an ordinary individual without the relevant business or other grounds. Choose by legal circumstances, not nationality.

Does PIT-11 replace my return?

No. It is payer information; the taxpayer checks the annual assessment and acceptance.

Do fewer than 183 days guarantee non-residence?

No. Personal or economic interests and the applicable treaty also matter.

Do two jobs create two tax-free allowances?

No, the annual scale allowance is shared. Separate withholding can produce tax due.

Is 32% charged on all income?

No. The current higher rate applies to excess over the taxable-base threshold, not automatically gross wages.

Does receiving 800+ automatically give child relief?

No. Entitlement, months, income and allocation need separate checks and PIT/O.

Does youth relief remove ZUS contributions?

No. This is a tax exemption for specified income before 26 within its limit; insurance rules are separate.

Do foreign wages always go into PIT-37?

No. Residence and treaty method matter; PIT-36/PIT/ZG is often needed. Not every transfer between your accounts is new income.

Does automatic acceptance pay tax due?

No. Filing and settling the amount are separate. Recheck the 2027 mechanism after launch.

Will a refund arrive immediately?

No. The ordinary period is 45 days electronically or 3 months on paper, with applicable correction, verification and offset rules.

How do I prove submission?

Retain the accepted return, attachments and UPO. A draft or screenshot is not acceptance evidence.

When must this guide be updated?

Mandatory editorial review: 15.02.2027, covering form, 2026 availability, interface, reliefs, automatic acceptance and official KAS instructions.

Submission checklist and mandatory review on 15.02.2027

Residence and the correct form are established. Every payer and correction is included. Year, identifier, income, costs, advances and attachments are reconciled. Child and other eligible reliefs have no double claims. Foreign sources follow the treaty. Individual or joint assessment is lawful, the account and tax due are checked, and the accepted return and UPO are retained.

Mandatory editorial update: 15.02.2027. Before actual submission, check PIT-37, availability of 2026 income in Twój e-PIT, the current interface, reliefs, automatic acceptance and new KAS instructions. This advance publication does not promise an unchanged future service or an individual refund amount.
