Najem okazjonalny is a special residential tenancy regime, not an “occasional” short stay. Its central feature is the tenant's notarial declaration submitting to enforcement of an obligation to vacate. It makes obtaining an enforceable document easier for the owner after the tenancy lawfully ends; it does not authorise self-help eviction.

Before signing, answer three questions: does the owner qualify for this regime, is your own set of attachments complete, and is there a workable exit from the fixed term? Eligibility for an alternative-accommodation exemption needs separate checking: in 2026 it is linked to temporary protection, not simply a Ukrainian passport.

Checked 18.10.2026. Next scheduled review: 18.01.2027. This guide examines the special regime in depth. Searching, budgeting, checking a property and handing over keys are covered in the complete rental guide. If you have already chosen a flat, start with the agreement and attachments below rather than repeating the whole search.

When an agreement really qualifies as najem okazjonalny

Article 19a of the Tenants Protection Act concerns a dwelling whose owner is a natural person not conducting a business of letting premises. The agreement must have a fixed term of no more than 10 years. Writing okazjonalny in the heading does not replace these conditions or the required documents.

A company professionally letting homes may use another regime, including najem instytucjonalny. Do not treat it as the same agreement: attachments and safeguards differ. If an agent represents the landlord, establish the owner's identity and the agent's authority. An intermediary neither turns an individual into a company nor proves eligibility for the special regime.

The main agreement and amendments require written form on pain of invalidity. Ordinary messenger exchanges do not replace a properly executed written amendment. For electronic form, a legally sufficient signing method matters: an image of a signature is not equivalent to legally recognised electronic form. Most tenants should obtain signed copies and every attachment.

Foreign nationals may be tenants. The regime does not universally require a karta pobytu or Polish citizenship. The notary must nevertheless establish identity and ensure understanding. Renting does not legalise residence: a passport, PESEL, address registration and a legal basis for staying serve different purposes.

Ordinary residential tenancy versus najem okazjonalny
Issue Ordinary residential tenancy Najem okazjonalny
Term Fixed or indefinite Fixed, no more than 10 years
Landlord Wider scope, depending on the applicable regime Natural person outside a premises-letting business
Form General rules; a written agreement is practically essential Agreement and amendments in writing on pain of invalidity
Notary No universally required declaration Tenant’s notarial declaration to vacate
Alternative accommodation No such special set of attachments Dwelling identified and titleholder consent, unless exempt by law
Kaucja General statutory maximum: 12 monthly rents Maximum: 6 monthly rents
Rent increases General applicable rules and restrictions Only under contractual conditions, Article 19c
Vacating Normally the general court route Demand, court enforcement clause for the deed, then bailiff
Tenant rights General safeguards Some safeguards excluded, but law and contract still prohibit arbitrary action

Documents: who signs and in what form?

Build the document set by purpose, not by the label “notarised”
Document Person responsible Purpose Form or qualification
Main agreement Landlord and tenant Use, term and payments Written; the entire agreement need not be a notarial deed
Submission to enforcement Tenant Commitment to vacate and surrender the dwelling Notarial deed, Article 19a, paragraph 2, point 1
Alternative dwelling designation Tenant Where the tenant can live if vacating is enforced Attachment unless a statutory exemption applies
Alternative titleholder’s consent Owner or other legal titleholder Residence for the tenant and co-residents Notarised signature if the landlord requests it
Identity document Each participant for their action Identity verification Valid document accepted by the notary
Title to the rented flat Owner or representative Check the property and authority Register and relevant documents; no invented universal certificate
Representative’s authority Person acting for owner Authority to execute relevant documents Form and scope appropriate to the action
Temporary-protection evidence Tenant claiming exemption Basis for omitting alternative accommodation Current status, not nationality alone
Handover record Parties at handover Condition, keys and meters Practical evidence; not a replacement for the notarial declaration
Tax-notification acknowledgement Landlord Condition for special mechanisms Must be shown at the tenant’s request

First request the complete draft, including attachments. Check that the address, flat number, names, term and household details match throughout. With multiple tenants, ask the notary in advance which declarations are required and the scope of each person's obligation. Do not assume one signature automatically covers everyone.

The person consenting to alternative accommodation must actually hold an appropriate legal title. A relative merely living there may lack authority to house you. For co-ownership, restrictions in their tenancy or representation, establish necessary permissions before the appointment. Do not copy another person's template without checking the signatory's legal capacity.

Check title to the rented property using the known land-register number and supporting documents. The official EKW service is not a search for all properties owned by a named person. Matching names in a message and listing do not replace checking identity documents and authority.

What the notary does—and what remains your responsibility

The regime requires an oświadczenie w formie aktu notarialnego: the tenant submits to enforcement and undertakes to vacate and surrender the dwelling within the period stated in the statutory demand. This is different from certifying a signature on an ordinary agreement. A signature-authentication stamp does not replace the required deed.

The notary identifies the participant, establishes the action's content, explains its consequences and records the declaration. That involvement does not automatically establish a good price, ensure the owner completes repairs or make every commercial clause fair. Negotiate early-exit rights and expenses before signing; do not expect a notarial seal to remove inconvenient terms.

Under Articles 2 and 87 of Prawo o notariacie, language comprehension must be ensured. Tell the office beforehand if your Polish is insufficient: translation and an appropriately qualified interpreter must be arranged as required. A friend with some Polish will not necessarily suffice. Do not say “I understand” if you do not understand the consequences.

Send the draft before booking and state the number of tenants and language needs. Ask who must attend, which originals to bring, how many official copies are needed and the full cost. The landlord normally need not attend the tenant's unilateral declaration, but agree the particular document set with the office. Another titleholder can separately certify a signature if required.

Before signing, verify that the obligation concerns the correct agreement and dwelling. Do not sign additional monetary submission to enforcement, a guarantee or unlimited debt acknowledgement when you expected only a declaration to vacate. These may be separate obligations with different consequences and costs.

Notarial costs in 2026: the ceiling and a worked example

Under Article 19a, paragraph 7, remuneration for the specified declaration cannot exceed 1/10 of the minimum wage. The monthly minimum in 2026 is 4806 PLN under the applicable regulation. The remuneration ceiling for that action is therefore 480.60 PLN. This is an upper limit, not a compulsory flat price charged by every office or the price of every notarial document.

Ask whether a quote is netto or brutto. VAT of 23% is normally added; official copies and any interpreter are calculated separately. Section 12 of the maximum-fees regulation provides up to 6 PLN per started copy page. Copies and pages affect the total; additional actions have their own fee basis.

Illustrative maximum-fee calculation: declaration and two copies of three pages each
Item Calculation Amount
Declaration, netto 4806 × 1/10 480.60 PLN
VAT on declaration 480.60 × 23% 110.54 PLN
Declaration, brutto 480.60 + 110.54 591.14 PLN
Two three-page copies, netto 2 × 3 × 6 36.00 PLN
VAT on copies 36.00 × 23% 8.28 PLN
Illustrative total 591.14 + 36.00 + 8.28 635.42 PLN

This is an arithmetically checked example under stated assumptions, not a binding quote. It excludes an interpreter, certification of another signature and extra deeds. Lower remuneration or a different number of copies changes the result. Request a written breakdown beforehand. If a quote is substantially higher, first establish what services it includes rather than immediately assuming a breach.

The law does not establish a universal rule that only the tenant must pay the whole bill. Agree the allocation between the parties in the contract. Separately address reimbursement of agreed costs if one party causes the deal to fail. An intermediary's fee for arranging an appointment is not the notarial fee and should be shown separately.

Unless exempt, the tenant identifies another dwelling where they can live if the obligation to vacate is enforced. Its owner or another legal titleholder consents to the tenant and co-residents living there. At the landlord's request the signature is notarised. That does not necessarily turn the entire consent into a notarial deed.

A friend or relative's home can be considered, but consent must be genuine. The tenant need not own the alternative flat. Do not assume a friend who rents can accommodate your whole family: check their title, use conditions and required permissions. Consent must not promise something the signatory cannot provide.

Identify the dwelling and people accurately. A town name or a real address that is unavailable is insufficient as a practical safeguard. Buying a “certificate” from an unknown intermediary is risky: paper does not guarantee real accommodation and false details can create another dispute. Do not circulate someone else's document copies without consent and a proper basis.

An address outside Poland cannot be assessed through an advertisement promising that any foreign address always qualifies. The law refers to a real dwelling and ability to live there; enforcement also has territorial implications. Ask the notary and landlord about your specific foreign documents, translation and actual availability beforehand. No universal acceptance guarantee has been established.

If that accommodation becomes unavailable, the tenant has 21 days from learning of the loss to identify another dwelling and supply the required consent. The period does not start with an owner's letter or at month-end. Failure can allow written termination with at least 7 days' notice under Article 19d, paragraph 5. These particular obligations do not apply to beneficiaries of the statutory exemption.

Foreign residents and temporary protection: the position in 2026

Nationality alone does not determine the document set. The general route applies to an ordinary foreign tenant, including an EU citizen, temporary-permit holder or Ukrainian citizen without the relevant protection. Having no Polish relatives does not create an automatic exemption; having a residence card does not remove attachments.

Current Article 112e of the Act on protection for foreigners exempts a tenant who is a temporary-protection beneficiary from Article 19a, paragraph 2, points 2 and 3, paragraph 3 and Article 19d, paragraph 5. This removes the alternative-dwelling designation, titleholder consent and associated replacement duty. The notarial submission to enforcement remains required.

Do not translate this into “all Ukrainians can skip the notary” or “every foreign passport removes the address requirement”. Check the particular person's status at the relevant date. PESEL UKR and protection records need current assessment; an old document copy may not reflect present circumstances.

The Act of 23 January 2026 introduced the new framework, generally from 5 March 2026, with transitional provisions. Older explanations citing only Article 69 of the Ukrainian special act should not be the sole basis for a decision. Transitional Article 51 addresses earlier agreements. A change of protection status during a tenancy requires individual assessment of that agreement and any further attachments.

Before attending, tell the notary the basis for claiming the exemption and send supporting documents securely. If the owner still requests alternative accommodation, distinguish the statutory document set from a commercial preference. You can negotiate or choose another property; do not sign a fictitious attachment to pass a formality.

Organising the signing so documents remain consistent

Agree the final draft before booking “any available appointment”. Tell the office the property, agreement date, number of tenants, required declaration and language. Separately identify a protection-based exemption where applicable. Do not send unnecessary bank statements or complete personal-document archives through a random intermediary.

Check the payment sequence. If the deposit and initial rent are paid before keys are handed over, record the purpose, recipient, handover date and consequences of failure to complete. A notarial deed does not insure an advance against fraud. The payee should match the agreement or have a clear documented basis to act for the owner.

At the appointment, check document numbers, name transliteration and address. An error in one attachment can complicate later steps. Correct discrepancies consistently throughout the set rather than making an isolated handwritten addition. If your Polish is limited, prepare questions in a language you understand: what the declaration permits, which agreement it covers, when the duty to vacate arises and how to receive your copy.

Ask for explanations during the reading. Translation should communicate legal meaning, not merely pronounce different words. If a party refuses to provide a draft beforehand, postponing signing until you can read the entire set is reasonable. Urgency does not make an unclear obligation safe. Agree the revised date and treatment of sums already paid in writing. Keep the official copies and clarify who receives which version.

Record the handover separately: condition, existing damage, meters, keys, equipment and agreed repairs. Even excellent notarial paperwork does not show whether a scratch predated your arrival. Link photographs to the record and date; include close-ups of relevant defects rather than only general room views.

After the tenancy starts, set a reminder to request tax-notification acknowledgement. The deadline binds the owner, but checking completion helps both parties. Keep written rent changes and other agreements with the original. Scattered messages should not become the only record of current conditions.

Mistakes that can become expensive

The first mistake is treating a label as a guarantee of legality. If a company lets the property, the term is indefinite or the required declaration is absent, establish the actual regime rather than changing a heading. The second is confusing a certified signature with a notarial deed: they perform different functions.

The third is signing documents that cannot be fulfilled. A fictitious alternative address, consent from someone without a legal title or an inaccurate household list does not improve your position. If the set cannot be completed, discuss another agreement or property before incurring costs instead of promising any paper after moving in.

The fourth is assuming that missing notarial or tax paperwork automatically permits you to stop paying. Defects in a special mechanism and obligations arising from occupying a home are different issues. Preserve evidence and seek assessment before taking a step that may create arrears.

The fifth is treating the deposit as the price of an early exit regardless of the contract. Kaucja secures claims; losing it does not necessarily end future rent liability. If the owner agrees to release you for a sum, record termination and the final settlement in writing, including any remaining claims.

The sixth is ignoring delivered documents. Even an apparently defective notice should be kept with its envelope, receipt date and attachments. Show court papers to an adviser promptly. Do not acknowledge an earlier receipt date that is untrue or assume silence stops the owner or bailiff.

These checks need not turn every tenancy into litigation. They expose concrete mismatches beforehand: who signs, which obligation arises, who pays and when the relationship ends. Clear answers reflected in the documents leave less room for unpleasant surprises.

What to agree in the main contract

Statutory requirements cannot be replaced with a convenient checklist. Equally, legally correct attachments do not fix an agreement that leaves payment and departure unclear. The following is a practical content check, not mandatory statutory wording.

  1. The owner's identity, signatory and representative's authority.
  2. The exact address, flat, rooms and property included.
  3. Start and end dates and the key-handover date.
  4. Named tenants and agreed co-residents.
  5. The actual czynsz najmu and payment method.
  6. Separate administrative and utility charges, advances and reconciliation.
  7. Permitted rent-increase conditions under Article 19c.
  8. Kaucja amount, purpose, payment and refund method.
  9. Repairs and procedures for emergencies and defects.
  10. Agreed inspections consistent with the home's inviolability.
  11. Specific grounds and periods for early fixed-term termination.
  12. Proper notice form and working delivery addresses.
  13. The notarial declaration and other attachments or a statutory exemption.
  14. Allocation of notary, copy, interpreter and intermediary costs.
  15. Return handover, condition, keys, meters and final settlement.

Precision matters more than template length. “The tenant pays all costs” leaves room for disputes about unexpected work. “The owner may enter at any time” does not legitimise unlawful intrusion. “The deposit is never refundable” must be assessed against its purpose and genuine claims.

For renewal, clarify form and the attachments' scope. Do not assume an old declaration covers every future property and changed obligation. Show material changes of term, parties or property to the notary before signing. That is easier than a dispute after the tenancy ends.

Kaucja: maximum, refund and revaluation

The maximum is 6 monthly rents at the rate on conclusion. This is a ceiling, not a required amount. With monthly rent of 3000 PLN, the ceiling is 18000 PLN; the parties could agree 3000 PLN. Do not substitute all utility advances for the rent without checking payment composition.

The deposit secures the owner's rental claims due when the dwelling is vacated and possible costs of enforcing the obligation to vacate. It is returned within a month after vacating, less valid claims. Withholding everything “just in case” is not an itemised settlement. Ask for each deduction, its basis and evidence.

Article 6, paragraph 3 on revaluation applies through Article 19e. The refundable base reflects the ratio to rent when paid and the rent rate when returned, but is not lower than the amount collected before justified deductions. This is not automatic linkage to any inflation index.

Worked example: 3000 PLN paid against monthly rent of 3000 PLN, equalling one month's rent. The lawfully established rent at refund is 3200 PLN. The revalued base is 3200 PLN; an evidenced deduction of 200 PLN leaves 3000 PLN. If the rent increase itself is disputed, the calculation cannot be divorced from that issue. This example does not establish an owner's right to a particular deduction.

Do not use the deposit instead of the last rent without written agreement: that can create arrears. Record condition, meter readings, keys and handover date. See the deposit-refund guide and handover record guide for evidence.

Early departure, breaches and the end of the agreement

A fixed-term agreement ends on the agreed date. Wanting to change jobs or flats does not create a universal right to leave on a month's notice. Under Article 673, paragraph 3 of the Civil Code, early notice can be given in contractual cases; specific statutory grounds may also apply. Agree a concrete relocation exit beforehand.

If no suitable ground exists, propose a written mutual agreement covering the end date, handover, payments and deposit. Finding another occupant does not itself end your contract. Their participation needs an agreed legal arrangement; simply handing over keys does not discharge your obligations.

Article 19e retains Article 11, paragraph 2, points 1–3. For arrears this does not mean “any late payment, immediate eviction”: at least three full payment periods, a written warning of intended termination and an additional month to pay overdue and current sums are relevant, followed by the statutory notice form and period. Misuse and unauthorised subletting have their own conditions.

A dwelling that threatens health may engage a separate immediate-termination right under Civil Code Article 682. It is not a universal remedy for every inconvenience: relevant facts are needed. Keep defect reports, photographs and specialist records without risking safety merely to gather evidence.

The ordinary three-month framework for indefinite residential tenancies should not be mechanically applied to this fixed-term regime. Separate contractual grounds, statutory grounds and mutual agreement. If an owner serves notice, check the reason, form, service and end date; an emotional message does not resolve those issues.

Vacating: the demand, court and komornik

A notarial deed does not let the owner change locks, discard belongings or disconnect services to force departure. The tenancy must first end. If the tenant does not leave voluntarily, Article 19d provides for a written demand bearing an officially certified owner's signature.

The demand identifies the parties, agreement and reason the relationship ended, and sets a departure period for the tenant and co-residents of at least 7 days from service. This is a post-termination demand period, not a universal termination notice. Do not confuse it with 21 days for replacing alternative accommodation.

After unsuccessful expiry, the owner applies to court for a klauzula wykonalności for the notarial deed. Attachments include the demand with proof of service or registered posting, title to the property and tax-notification acknowledgement. Enforcement then belongs to a court bailiff—komornik—not an estate agent.

Enforcement and remedies are governed by the Code of Civil Procedure. The appropriate challenge depends on whether it concerns the clause, the underlying claim or the bailiff's acts. On receiving court papers, establish the applicable remedy and deadline immediately. Correspondence with the owner does not automatically suspend procedural deadlines.

This regime has narrower social safeguards than ordinary renting: do not assume a universal winter suspension or mandatory social accommodation. Equally, “you have no rights after the notary” is false. Record threats, unlawful entry or exclusion and seek appropriate urgent assistance. A deposit dispute does not authorise physical pressure.

Tax notification: the owner’s duty that matters to tenants

The owner notifies the head of the tax office for their place of residence within 14 days of the tenancy starting. This is not simply the notary-appointment date. The tenant can demand acknowledgement. Agree to obtain a copy after commencement and keep it with the documents.

Under Article 19b, paragraph 3, failure removes application of Articles 19c and 19d; Article 19e also makes exclusion of some ordinary safeguards conditional on notification. This seriously affects the special mechanism, but does not mean every such agreement automatically disappears or rent need no longer be paid. Assess the specific dispute legally.

The tenant should not impersonate the owner or file the owner's notification in their own name. Distinguish this from the owner's income-tax settlement, the tenant's meldunek and submitting a tenancy for immigration purposes. Address registration is separate and does not replace this notification.

Six situations before signing and when leaving

These are composite teaching situations, not individual legal opinions.

A foreign resident's first agreement

The owner demands a “notarial contract” but sends only an ordinary template. Ask for a list: main agreement, tenant declaration, alternative dwelling and consent or exemption. Send everything to the notary and agree language and price. Do not pay for an undefined package based on a label.

No alternative address in Poland

Without a statutory exemption, honestly discuss an ordinary agreement or another property. You can seek genuine titleholder consent, but should not buy a fictitious certificate. No local acquaintances does not create an exemption; an intermediary's promise cannot replace title and consent.

The office proposes additional deeds

A large monetary submission to enforcement is added alongside the obligation to vacate. Request a separate explanation of purpose, limits and cost. Do not sign an unclear debt acknowledgement. The declaration required by the regime does not imply consent to every extra guarantee.

The tenant has temporary protection

Check current status and Article 112e eligibility, and agree supporting evidence. The exemption removes the alternative dwelling and consent, not the notarial declaration. Correct conflicting template clauses before signing rather than entering a fictitious address.

A job change requires early departure

Find the contractual ground and notice period first. If absent, propose mutual termination and settlement. A replacement occupant does not automatically release you. Keep written confirmation of the end and do not stop paying merely because your belongings have moved out.

A demand to leave arrives and the deposit is withheld

Separate the tenancy's termination and vacating issue from deposit settlement. Check signature, grounds and service; seek prompt advice on court papers. Request a separate deduction statement. The demand itself does not prove damage equalling the entire deposit.

Writing to the owner in Polish

Before signing: Proszę o pełny projekt umowy najmu okazjonalnego wraz z załącznikami oraz informację, kto pokrywa koszty aktu notarialnego, wypisów i ewentualnego tłumaczenia. Proszę również wskazać zasady wcześniejszego rozwiązania umowy.

Protection exemption, if applicable: Korzystam z ochrony czasowej. Proszę o uwzględnienie art. 112e ustawy o udzielaniu cudzoziemcom ochrony na terytorium RP i uzgodnienie z kancelarią dokumentów potwierdzających mój status.

After commencement: Proszę o przedstawienie potwierdzenia zgłoszenia zawarcia umowy naczelnikowi urzędu skarbowego zgodnie z art.

These are examples of ordinary correspondence, not a notarial deed, ready-to-serve termination notice or universal procedural document. Use only true details and the agreed delivery channel.

Questions for the owner and a final check

  • Who owns the flat, and does their activity fit this regime?
  • Where are the full agreement, attachments and early-exit conditions?
  • Does the temporary-protection exemption apply and is it reflected?
  • If an alternative address is needed, who can genuinely consent?
  • Who pays what for the notary, copies and translation?
  • How are deposit payment and settlement documented?
  • When will tax-notification acknowledgement be supplied?
  • How are handover, defects, keys and notices recorded?

Compare the answers with the wording. An oral “we always return everything” is not a settlement method; “we will fill it in later” risks inconsistent documents. Consult the contract checklist and official free legal assistance information. A dispute with a private owner is not necessarily a consumer dispute with a business.

Frequently asked questions

Is this a short-term rental agreement?

No. The name identifies a special legal regime. It has a fixed term of up to 10 years and can cover ordinary long-term living. It should not be equated with a tourist booking.

Does a foreign tenant need a karta pobytu?

The regime does not universally require that particular card. Identity must be established and status checked where legally relevant. Ask the office beforehand which documents it accepts; a tenancy does not itself legalise residence.

Must the entire contract be notarised?

The special tenant declaration must be a notarial deed. The main agreement requires written form, not necessarily a deed. Certification of a separate consent signature is another action and should not be confused with the deed.

Can I proceed without alternative accommodation?

Yes if the statutory temporary-protection exemption applies. Otherwise the relevant set and a real ability to live there are required. Having no acquaintances in Poland is not itself an exemption.

Is every Ukrainian exempt from the address?

No. Eligibility depends on temporary-protection status and the rule applicable at the time. Nationality and status differ. The tenant’s notarial declaration remains required even with the exemption.

Can I use a friend’s home?

If someone with an appropriate legal title genuinely consents and accommodation is real. Not every occupant can house others. Household members, the signatory’s rights and any required signature certification matter.

What if the alternative flat is sold?

If you lose the ability to live there and are not exempt, identify another dwelling and supply consent within 21 days of learning of the loss. Do not wait until the tenancy ends; failure can trigger special termination.

How much does the notary cost?

The 2026 remuneration ceiling for the specified declaration is 480.60 PLN, normally plus VAT. Copies, interpretation and additional actions affect the total. Ask for a complete breakdown rather than an undefined package price.

Who must pay the notary?

Agree cost allocation beforehand. A mandatory declaration does not prove every additional service must be paid exclusively by the tenant. An intermediary’s commission is separate.

Can the owner evict immediately after the notary?

No. The relationship must end, the statutory demand must be made and a court enforcement clause and lawful execution obtained. The deed does not authorise changing locks, removing belongings or physical exclusion.

Can I leave on a month’s notice?

Not automatically. Check specific contractual and statutory grounds for this fixed term, or negotiate an agreement. Moving and returning keys without settlement do not always end payment obligations.

What is the maximum deposit and refund deadline?

For najem okazjonalny, 6 monthly rents at the rate on conclusion. Return is within a month after vacating, with justified deductions and applicable revaluation. The maximum is not a recommended compulsory amount.

Is the agreement invalid if the owner failed to notify tax authorities?

That blanket conclusion is unsafe. Losing the special provisions has serious consequences but does not automatically extinguish every obligation. Request acknowledgement and obtain advice on the actual agreement if disputed.

Does this agreement provide meldunek and residence rights?

It can evidence housing use for a separate registration procedure. It does not replace that procedure or independently create residence or work rights. The owner’s tax notification is separate too.

The basis is Articles 19a–19e of the Tenants Protection Act, relevant Civil Code provisions, Article 112e of the foreigners-protection act, transitional rules for 2026, Prawo o notariacie and maximum-fee rules. Official links accompany the relevant conclusions. Draft legislation is not presented as current law. Foreign alternative addresses, changing protection status and contested termination grounds need assessment of actual documents rather than an invented universal answer.
