Checked 18 October 2026. Next scheduled review:18 January 2027, earlier if legislation changes. This guide covers private long-term residential renting. Social, employment-linked, tourist and institutional tenancies may follow different rules.
A safe tenancy starts before the deposit transfer. Establish who may let the flat, the total cost and how you can leave. Even a neatly presented agreement is difficult to use if it leaves unclear who repairs the fridge, how heating is reconciled and when the kaucja is repaid.
We cover the complete cycle: searching, checking, contracting, handover, occupation and final settlement. If you already have a contract and need a short review list, use our pre-signing checklist. It complements the detailed explanation here.
Polish rental terms: what are you paying for?
| Polish term | Meaning | Check |
|---|---|---|
| Najem / umowa najmu | Tenancy / tenancy agreement | Whole flat, room or another specified subject |
| Wynajmujący | The letting party | Owner or another authorised person |
| Najemca | Tenant | Contracting tenants and permanent occupants |
| Czynsz najmu / odstępne | Rent paid for use of the property | Amount and increase mechanism |
| Czynsz administracyjny / opłaty administracyjne | Building-management/cooperative charges | Included water, heating, waste and other items |
| Media | Utilities and services | Electricity, gas, water; advance or actual consumption |
| Kaucja | Refundable security for obligations | Amount, payment evidence and settlement |
| Protokół zdawczo-odbiorczy | Handover/return report | Condition, meters, inventory and keys |
| Najem okazjonalny | A specific tenancy regime with a notarial declaration and other conditions | A landlord simply using the name is not enough |
Czynsz can refer to different amounts. In an advert saying “3000 plus czynsz 700”, the first figure often means rent and the second building charges. Obtain a written breakdown: “everything included” without a list or surcharge rules does not establish a reliable budget.
There is no single verified average that fits every city, neighbourhood and property standard. Compare similar listings using total cost, duration and equipment. A low headline rent with electric heating and uncertain consumption can cost more than a higher rent with clear bills.
Where to search and how to use an agent
Search platforms include Otodom, OLX Nieruchomości and Morizon. A recognised platform does not verify every landlord or guarantee payment safety. Save the listing, complete price, address and correspondence before it disappears.
A direct let involves the letting party; an agency adds a separate brokerage service. Whether you owe commission, how much and when depends on the brokerage agreement, not merely an agent attending the viewing. A “mandatory one-month commission” is not a universal statutory rate.
Before signing an umowa pośrednictwa, establish the agency’s obligations, which property triggers commission, whether VAT is included, when the service is completed and what happens if no tenancy is concluded. Ask for business details, the employee’s authority and compulsory professional-liability insurance, OC. The Real Estate Management Act requires the brokerage agreement in written or electronic form on pain of invalidity and requires liability insurance.
A paid address list is not the same as finding a flat. If payment merely buys access to advertisements, establish exactly what is delivered and whether availability is guaranteed. An agent does not remove the need to inspect the flat and verify the letting party’s authority.
Check the advertisement, owner and authority
- Establish the address and property. Inspect personally or through a reliable representative. A video without a verifiable connection to the address is insufficient.
- Identify the signatory. Match identity to documents and authority to let. For a representative, check the power of attorney, validity and scope.
- Ask for the księga wieczysta number where a book exists. The official EKW service provides free viewing with the known number. Do not use unlawful personal-data searches.
- Match the book to the flat. SectionI describes the property/associated rights, II ownership, III restrictions/claims and IV mortgages. Wzmianki, notices of pending applications, also matter.
- Investigate special circumstances. Co-ownership, inheritance, subletting, cooperative rights and representation need appropriate evidence, not one universal document set.
- Check the payment recipient. An agent or third party receiving money needs a clear documented basis.
- Have a verifiable agreement before advance payment. Reservation, refund and signing conditions should be written, not only a voice message.
A mortgage does not itself prohibit letting. Seizure, disputed rights, a pending entry or unclear authority may require explanation and legal advice before payment. Do not decide from one entry heading alone. If no separate book exists, ask for the relevant other title, such as a cooperative right; a missing number does not automatically prove fraud.
A current management statement shows charges, not necessarily every outstanding liability. Ask about utility balances and agree who bears costs predating your occupation. Do not silently accept a former occupant’s debt merely to receive keys. Record opening balances, meter readings and the start of your responsibility in the agreement and handover report.
Verify identity and record necessary contract details without collecting excessive copies or publishing personal information. Official guidance: checking a property’s legal status.

An ordinary tenancy agreement: settle these points first
Oral arrangements create evidence problems. The practical choice is a signed document and attachments for each party. For property let for more than a year, the Civil Code separately regulates the consequences of missing written form: it is incorrect to call every oral tenancy automatically invalid.
| Area | Record | Common problem |
|---|---|---|
| Parties and property | Names, notice addresses, authority, flat/room and additional spaces | Someone signs without authority |
| Duration | Start, end or indefinite term; key-handover date | The advert promised a different term |
| Payments | Separate amounts, dates, recipients, advances and reconciliation | One total without its components |
| Kaucja | Amount, payment date, secured obligations and return | Security confused with a non-refundable reservation |
| Handover | Report, photos, keys, meters and equipment | “No defects” signed despite faults |
| Occupation | Residents, pets, subletting and shared space | Oral permission contradicts the document |
| Repairs and access | Notification, payer and scheduled visits | Owner assumes unlimited access |
| Termination | Grounds, notice, form and mutual agreement | Fixed term without a usable exit clause |
| Return | Moving out, inspection, final bills and repayment details | Keys returned without a confirmed date |
Do not sign empty attachments or leave prices to be inserted after paying. With two language versions, compare meaning, especially negatives, time limits and termination grounds. A prevailing-language clause does not explain an unclear provision: obtain a translation or advice before signing.
Discuss pets, smoking, bicycles and working from home beforehand. Permission for home working does not automatically authorise any business, customer visits or transferring the flat to others. For a room, settle shared-kitchen/bathroom rules, costs and responsibility for other occupants’ damage.
A signature does not make every clause lawful. Mandatory provisions may restrict contractual freedom, and a professional landlord’s or agent’s terms may be subject to consumer protection. Conversely, simply disliking the agreement does not cancel existing obligations.
Najem okazjonalny: documents, notary and consequences
Under Articles 19a–19e of the Tenants Protection Act, this concerns a residential property owned by an individual who is not carrying on a property-letting business. It is fixed-term, for no more than 10 years. Professional letting has a separate regime, najem instytucjonalny; a notarial element does not make them identical.
The agreement and amendments require written form on pain of invalidity. Attachments normally include the tenant’s notarial submission to enforcement of the obligation to vacate and return the flat, identification of another dwelling available if enforcement occurs, and consent from someone holding legal title to that dwelling. The letting party may require the consent signature to be notarised. A notarial tenant declaration is different from executing the whole contract before a notary.
Normally, if the alternative dwelling becomes unavailable, the tenant has 21 days from learning this to identify another and provide the required consent. Temporary-protection beneficiaries have a statutory exception below. Buying a fictitious consent from a stranger does not provide real accommodation and can create a dispute about the declaration’s truthfulness.
Important 2026 rule for temporary-protection beneficiaries
From 5 March 2026, Article 112e of the Protection of Foreigners Act, added by the 23 January 2026 Act, Dz.U.2026 item 203, provides the relevant exception. A temporary-protection beneficiary does not have to identify the alternative dwelling or obtain its title-holder’s consent, and the related replacement requirement does not apply. This exception does not remove the notarial submission to enforcement.
This is not an exemption for every Ukrainian passport-holder: protection status matters. Article 51 applies the new rule also to contracts previously concluded under Article 69 of the Ukrainian assistance act. An old recommendation to cite Article 69 alone is therefore insufficient. Discuss proof of status and the exception with the notary before paying. Official amendment and transitional provision.
Tax notification, costs and eviction
The owner must notify the head of the tax office for their place of residence within 14 days from the start of the tenancy and provide confirmation at the tenant’s request. Missing notification affects use of the special regime; it does not automatically make the entire agreement nonexistent. Request proof once the deadline is reached.
The notary’s remuneration for the Article 19a declaration is capped at one-tenth of the statutory minimum wage. This is not one all-inclusive price: VAT, copies, other signature certifications and an interpreter are separate matters. The cap does not by itself determine which party pays; agree the allocation in writing before booking.
The declaration facilitates the statutory enforcement route after termination, but does not let the owner immediately change locks. The law requires a written demand to vacate with officially certified owner signature and at least 7 days from service, followed, if necessary, by an application for an enforcement clause with the required documents. Enforcement is for the authorised body, not the owner and friends.
Protection differs under this regime. Understand termination grounds, alternative accommodation or the statutory exception, service of notices and access to legal help, not merely the notary’s price. A document does not become non-binding simply because its language was unfamiliar.
Total cost: a monthly budget and move-in funds
Ask for the latest management charges and utility-settlement method. Water and heating are often advances reconciled later; electricity, gas and internet may have separate contracts. Do not add water twice when already included in administracja. Agree who receives overpayments and how final statements are delivered after departure.
| Item | Assumption | PLN |
|---|---|---|
| Rent to owner | Monthly | 3000 |
| Administracja | Includes water/heating advances and waste | 700 |
| Electricity | Separate assumed monthly consumption | 150 |
| Internet | Separate service | 60 |
| Parking | Not rented | 0 |
| Normal monthly total | 3000+700+150+60 | 3910 |
| Move-in kaucja | Agreed refundable security of 3000 in this example | 3000 |
| Agency commission | Assumed one-off gross contractual amount | 3000 |
| First month and move-in total | 3910+3000+3000; excluding notary, removals and new purchases | 9910 |
Without agency commission, this example requiresPLN 6910. Add any agreed full notarial cost separately. These are not market benchmarks, mandatory commission or confirmation that a particular deposit is sufficient: they demonstrate a transparent calculation.
Use the same table for competing flats and add commuting, personal service contracts and seasonal adjustments. A refundable deposit is not a recurring monthly cost, but it ties up cash. When moving between homes, the old deposit may arrive after the new move-in payment, so allow for overlap.
If charges depend on occupants, ask what changes when a child or partner moves in. Heating advances depend on the billing period, property and method, not merely a promise that they always cover consumption. There is no single electricity or gas tariff assumed for all contracts here.
Kaucja: limits, evidence and repayment
For ordinary tenancies within the Tenants Protection Act, Article 6 caps security at 12 monthly rents at contract conclusion. For najem okazjonalny, Article 19a caps it at 6. These are legal maximums, not recommended or usual market amounts. Najem instytucjonalny has a separate 6-rent provision, but its other conditions cannot simply be copied from ordinary tenancy law.
The reference is rent for the premises, not an arbitrary total including every utility. Evidence payment with a bank record naming its purpose and address, or a receipt from an authorised recipient for cash. Keep kaucja distinct from first rent, agency fees and reservations.
For ordinary and occasional tenancies, the statutory return period is one month from vacating, after lawful deductions. That is not necessarily 30 days or an indefinite wait for every annual bill. Article 6(3) also provides revaluation based on the multiple of the rent applicable on return, no less than the amount collected; Article 19e applies this to occasional tenancies. Increased rent may therefore affect the starting repayment calculation.
For example, where this statutory revaluation applies, security of one monthly rent initiallyPLN 3000 and relevant rent ofPLN 3300 on repayment gives a starting amount ofPLN 3300 before lawful deductions. This is a separate worked example, not a promise of an increase under every contract.
Arrears, proven damage and other secured obligations may justify deductions. Ordinary wear from proper use is not new damage. Charging for expensive new furniture instead of an old worn item is not automatically lawful. Request a calculation, basis and evidence, considering initial condition, age and the agreement.
Do not stop paying the final month merely because the landlord holds security: without an appropriate agreement this can create arrears. Identify disputed amounts separately. See our deposit-recovery guide; a cautious sample demand appears below.

The handover report: record verifiable details
A report protects both parties. “Good condition” is insufficient. Check each room: walls, floors, windows, doors, plumbing, furniture and every included appliance. Test accessible functions, water and lighting; do not dismantle hazardous installations or remove seals.
Record meter numbers, readings and units, keys, fobs and remotes. Note service-contract and instruction handovers. Tie photos to the report through filenames or an attachment list: a general kitchen view and a damage close-up do different jobs. Both parties should receive matching attachments.
| Polish sample | Meaning in English |
|---|---|
| Stan licznika energii elektrycznej nr [NUMER]: [ODCZYT] kWh na dzień [DATA]. | Electricity meter [NUMBER]: [READING] kWh on [DATE]. |
| Na drzwiach lodówki widoczne wgniecenie, zdjęcie nr [NUMER]. | Visible dent on the refrigerator door, photo [NUMBER]. |
| Przekazano [LICZBA] komplety kluczy oraz [LICZBA] piloty. | Handed over [NUMBER] sets of keys and [NUMBER] remotes. |
| Strony uzgadniają usunięcie usterki [OPIS] do [DATA] na koszt [STRONA]. | The parties agree repair of [DEFECT] by [DATE], paid by [PARTY]. |
A promised repair needs a specific obligation, deadline and payer. If something could not be tested, record that instead of signing “working”. Repeat inspection and readings at departure. Our protokół zdawczo-odbiorczy guide gives a fuller checklist.

Repairs, emergencies and landlord access
The letting party has statutory and contractual duties to maintain usable accommodation. The tenant must use it properly, report problems promptly and perform their own maintenance duties. Neither “the owner repairs every appliance” nor “everything inside is the tenant’s responsibility” is an adequate rule.
Articles 6a–6b allocate duties, but Article 6f permits different contractual allocation of duties under 6a–6e outside public housing stock. Read both law and the valid agreement. Civil Code Article 681 concerns minor tenant expenses,664 defects and 682 health-threatening defects. Consequences depend on the problem and circumstances.
Report a breakdown in writing with photos, discovery date and its effect on use; ask for an inspection and repair deadline. Do not commission an expensive replacement at someone else’s cost without agreement, unless a specific legal right genuinely arises in the circumstances. Keep expense documents.
Rent reduction or immediate termination are not automatic consequences of every fault. A broken kettle differs from a dangerous gas installation. With immediate danger, protect people and contact the appropriate emergency service; a cost dispute must not delay preventing harm.
Article 10 requires prompt access to deal with a failure causing or immediately threatening damage. If the occupant is absent or refuses, the statute provides entry with police or municipal guard, and fire service where necessary. This is not ordinary permission to enter freely with a spare key.
Routine inspection and work should have an agreed time. Set purpose, timing and attendees. Keeping a spare key does not remove the protection of the home. Record disputed messages and seek help: changing locks or cutting utilities is not transformed into lawful eviction.
Rent increases and utility adjustments
For ordinary tenancy, the statute regulates increases, written form and generally three months’ notice of a changed charge, unless the agreement gives longer. Further justification and challenge rules apply. A messenger text does not necessarily alter tomorrow’s rent.
For properly arranged and notified najem okazjonalny, Article 19c links rent increases to the agreement’s conditions. Read the indexation formula, dates and frequency before signing. Do not automatically apply ordinary tenancy’s three-month procedure to this special regime.
A water-consumption reconciliation or supplier tariff change is not always an increase in the owner’s rent. Require separated items and calculations. After a disputed notice, establish the applicable regime and response deadlines promptly: silence or unilateral underpayment can worsen the position. There is no universal advice simply to ignore an increase.
Meldunek does not create ownership
Meldunek records actual residence. It does not transfer ownership, make tenancy indefinite or legalise immigration status. An administrative obligation should not become a purchase of fictitious registration.
Procedures and deadlines depend on citizenship, residence category and duration. Select your category in the official foreigner-registration guidance. Do not apply EU-citizen deadlines or online eligibility to every foreign national.
Prepare identity and category-specific residence documents plus evidence of the right to use the property, such as the agreement. Address confirmation matters; where unavailable or disputed, ask the gmina/municipal office about the administrative procedure. A contract clause does not justify declaring a false address. Discuss necessary documents before signing.
If you lack PESEL, check whether the relevant procedure assigns it. Registration and immigration permission remain separate. See our first-steps guide for the broader move.
Ending the agreement and moving out correctly
Fixed term
Civil Code Article 673§3 permits termination in cases specified in the agreement. Job loss, a move or finishing study does not invariably end liability. Agree appropriate grounds and notice before signing. An agent’s oral promise of departure at any time does not resolve a one-year written commitment.
Indefinite term
For premises with monthly rent, Article 688 gives a default of three months’ notice ending at a calendar-month end. Consider valid contractual terms and mandatory rules. Residential landlords have separate statutory grounds and procedures; do not simply give them every tenant entitlement symmetrically.
Mutual agreement
Agree an end date and settlement in writing, including final rent, keys, outstanding charges and security. Finding a replacement tenant does not itself release you: obtain landlord acceptance and documented termination or another valid contractual mechanism.
Breach and notices
Serious defects or other breaches require the relevant grounds, evidence and procedural sequence. Do not copy an immediate-termination template without checking circumstances. A landlord cannot treat every late payment as instant eviction; arrears have statutory conditions and prior steps.
Send notices in the appropriate form to the contractual address and keep delivery evidence. “I am leaving” in a message may be insufficient. Notice, mutual agreement and physical return are different events. Arrange inspection, meters, keys, repayment details and a correspondence address before leaving.
Deposit not returned: a practical sequence
- Establish the regime and vacating date. Check the agreement, return report, keys and applicable one-month period.
- Collect evidence. Payment, initial/final reports, photographs, correspondence, charges and agreed repairs.
- Request written accounting. Ask for the starting amount, applicable revaluation, every deduction, basis and evidence.
- Separate debts from damage. Wear differs from damage; utility disputes require actual bills and periods.
- After the due date send a wezwanie do zapłaty. Give a justified amount, voluntary-payment deadline, account and basis; retain delivery proof.
- Consider settlement, legal help or proceedings. Court, evidence, costs and interest depend on the case. A demand is not a judgment or guaranteed recovery.

The deadline you insert is a proposed voluntary-payment period, not a replacement for the statutory return deadline. Avoid threats, unsupported criminal allegations or invented penalties. Five ways tenants lose money
Advance payment for a nonexistent flat
Warning signs include a suspiciously low price, urgency, an owner abroad, no reliable viewing and keys promised after an external-link payment. Verify address, photos and authority before paying. If money has gone, contact the bank immediately, keep correspondence, notify the platform and, where criminal conduct is suspected, police. Recovery is not guaranteed.
An intermediary without a verifiable service
Request the agreement, business details, service, gross commission and OC before paying. A vague shared database is not a promised flat. If delivery contradicts advertising, retain both and make a written contractual complaint.
Someone with keys pretending to be the owner
Keys and knowledge of the flat do not prove authority. Check identity, title and power to sign. Subletting requires the original agreement and required consent; representatives need authority for both contract and money. Courtesy and urgency are not reasons to skip checks.
Deductions for pre-existing defects
Protect yourself with detailed reports and dated photographs at both ends. A dent recorded on arrival is not new tenant damage. Request an itemised calculation rather than arguing over the phrase “the flat is ruined”.
Unexpected contractual extras
Check full prices, attachments, seasonal adjustments and agency services before paying. For an unexplained mandatory package, request the contractual basis and calculation rather than immediately accepting or ignoring it. Verify suspicious payment notices with a known recipient through independently held contacts.
Six everyday situations
1. No residence card
Explain the actual lawful status, show accepted identity evidence and offer clear income documentation. A card is not a universal condition for every private tenancy. For okazjonalny, examine alternative accommodation or protection status separately: no card does not itself establish the exception.
2. A family with a child
Agree permanent occupants, charges, safety and duration. A child or meldunek does not make the tenancy indefinite. Do not assume every family is exempt from eviction: contract type and lawful procedure matter. Seek legal/social help early if housing is threatened.
3. An agency flat
Before accepting commission, obtain the brokerage agreement and full gross amount. Establish the required result, contract signatory and payment recipient. Commission does not replace inspection, handover or your own signed agreement.
4. A fridge fails after moving in
Keep the initial test record, report the fault and request inspection. Establish cause and allocation under law and contract. Do not buy a replacement assuming its price can unilaterally be deducted from rent. For dangerous defects, protect people first and then document costs.
5. Leaving before the fixed term ends
Check contractual grounds. If none fits, propose a written termination agreement with date and settlement. A replacement candidate may help negotiation but does not end your agreement. Do not budget around a supposed universal one-month notice.
6. The entire deposit demanded for repainting
Compare initial condition, actual damage, ordinary wear, contractual duties and work costs. Request details. Once repayment is due, make a justified evidenced demand; do not describe every cleaning or repair deduction as automatically unlawful.
Frequently asked questions
Can I rent without PESEL?
Its absence does not itself make every agreement impossible. Identify the parties reliably and agree documents. Never use another person’s number. A landlord’s requirement differs from a general statutory rule.
Must the tenant pay the agency?
Not automatically. The obligation depends on the valid brokerage agreement. Establish the payer, gross amount, service result and commission trigger before signing.
Is a passport photograph enough to verify a landlord?
No. It proves neither the sender’s identity nor authority over this property. Check identity, title and powers together without collecting excessive personal data.
Can I pay cash?
The method does not replace evidence. Record amount, date, purpose, address and an authorised recipient’s receipt. Keep security, first rent and commission separate.
Is the deposit always one month’s rent?
No. Agree it within the applicable legal regime. Maximums of 12 rents for ordinary and 6 for occasional tenancies are not standard or compulsory amounts.
Must repayment happen after exactly 30 days?
The statute refers to a month from vacating, not a universal 30 days. Confirm the event/date and check calendar calculation before alleging delay.
Can security replace the last rent payment?
Without an appropriate agreement that can create arrears. Security is not automatically prepaid final rent. Settle the issue explicitly.
Can the owner enter without notice?
Ownership does not remove access rules or protection of the home. Agree routine visits; emergencies have a separate statutory route. A spare key is not general permission.
Does a protection beneficiary need alternative housing for okazjonalny?
Article 112e exempts the alternative-dwelling and title-holder-consent requirements. It depends on protection status, not any Ukrainian citizenship; notarial submission to enforcement remains.
Does a notarial declaration allow one-day eviction?
No. Termination, demand, court and enforcement rules still apply. The special route does not permit self-help lock changes or removal of possessions.
Does meldunek extend the tenancy?
No. Registration records actual residence. It grants neither ownership nor indefinite tenancy or immigration permission and does not cancel valid termination.
Can I leave one month after notice?
It depends. Fixed terms need relevant contractual cases; indefinite premises with monthly rent have the special Article 688 default, generally three months ending at month-end. Check before using a generic template.
Can a chat message increase the price?
Check the regime, form, deadlines and agreement. Ordinary and properly established occasional tenancy differ; utility reconciliation is also separate.
Who pays for a failed washing machine?
Cause, initial condition, work, law and valid contract terms determine responsibility. Notify promptly, preserve evidence and agree action. A new machine’s cost is not automatically deductible from rent.
