To leave a job without avoidable disputes, first identify the contract, the method of termination and the end date. An employee’s notice, mutual agreement and employer dismissal are different documents with different consequences. Signing to acknowledge receipt does not necessarily mean agreeing to leave, but signing a porozumienie stron may express exactly that agreement.
Foreign nationals have two parallel tasks: employment settlement and checking residence grounds and permission for the next job. Receiving wages does not extend a permit, and a valid plastic card does not always allow work for any new employer. Plan both routes before the last shift.
Checked on 22.10.2026. This guide explains ordinary employment contracts, with separate qualifications for zlecenie and B2B. It is not an individual opinion on your dismissal. A specific dispute requires the contract, the document served, employment history and the circumstances of termination.
Read the contract before choosing a resignation heading
Umowa o pracę is an employment contract governed by the Labour Code. Employment notice periods, paid annual leave and świadectwo pracy belong to this framework. Calling something a “contract” does not settle its status: check the parties, subject and legal basis. See the short definition of umowa o pracę.
Umowa zlecenie is governed by civil law. Termination depends on its terms and applicable rules, including important grounds for ending the arrangement. Employment notice periods cannot simply be copied, nor can paid leave or an employment certificate automatically be demanded. Earned remuneration and justified termination settlements do not disappear, however.
B2B describes cooperation between businesses, not one contract type with a universal exit period. Check notice, delivery of work, payment, confidentiality and liability in your actual agreement. If a civil label conceals subordinate work at a place and time determined by an employer, establishing an employment relationship may be an issue. A payment disagreement alone does not prove this; evidence of how the work was organised matters.
Four ways an employment contract can end
| Method | Meaning | What to check |
|---|---|---|
| Wypowiedzenie | Unilateral notice with the applicable period | Contract, service, delivery and end date |
| Porozumienie stron | Both parties agree to termination | Voluntary agreement, date and actual terms; not simply acknowledging receipt |
| Upływ czasu | A fixed-term contract reaches its agreed end | Special extension/protection rules, settlement and documents |
| Bez wypowiedzenia | Termination without a notice period | Specific statutory basis and deadlines; not an unrestricted right to leave today |
An employee’s ordinary notice does not require the employer’s agreement. Refusing to “let you go” does not turn properly delivered notice into a request without legal effect. Employees do not have to explain their personal reason for ordinary resignation. Stopping work before the notice period ends is different: notice does not release you from remaining duties.
Mutual agreement is useful when both sides genuinely want a particular date. You can discuss or reject a proposal. There is no general cooling-off period allowing every signed agreement to be freely cancelled after a few days. Challenging threats, mistake or another defect of consent requires a separate legal assessment and evidence.
A fixed-term expiry is not ordinary notice: the contract normally ends on its stated date without another declaration. Some protected situations change the result, such as pregnancy where statutory conditions are met. If work continues or another contract is signed, establish which contract now applies rather than relying only on the familiar rota.
Notice periods: contract and service with this employer
| Contract / condition | Period | Qualification |
|---|---|---|
| Fixed or indefinite term; service below 6 months | 2 weeks | Count qualifying service, including through the end of notice |
| Fixed or indefinite term; at least 6 months | 1 month | Not thirty freely counted days |
| Fixed or indefinite term; at least 3 years | 3 months | Not any three years working in Poland |
| Trial period no longer than 2 weeks | 3 working days | Separate probation rules |
| Trial period longer than 2 weeks but shorter than 3 months | 1 week | Do not apply the monthly service table |
| Trial period of 3 months | 2 weeks | Check the actual probation duration |
Fixed-term and indefinite-term contracts use the same basic service thresholds. Count qualifying service with the particular employer, including periods that must be aggregated, not just the date on the latest sheet. Transfers of an undertaking can involve succession rules. If the relevant service threshold is reached during notice, that period must be considered rather than freezing service on the date notice was submitted.
Service calculation changed in 2026: qualifying documented periods of zlecenie, business activity and other listed activity can count towards employment rights. Changes apply from 01.01.2026 in the public sector and 01.05.2026 in the private sector. For service with the present employer, relevant earlier activity must have been performed for that employer; years of JDG serving unrelated clients do not automatically become service for its notice period.
PIP explains the new periods and transitional rules. Obtain ZUS confirmation or other admissible records; overlapping periods cannot be counted twice. Notice already running when the new regime began has transitional restrictions. In October, a calculator that categorically excludes all previous zlecenie is unreliable, but adding your entire working life mechanically is equally wrong.
Calculate the end date without losing a month
A notice period expressed in weeks ends on a Saturday and covers complete weeks; a monthly period ends on the last day of a month. One month is therefore not thirty days from delivery. If monthly notice is served on 22.10.2026, the ordinary end is 30.11.2026. With three months for the same service date, it is 31.01.2027, absent another legal qualification.
For a two-week period served on 22.10.2026, the ordinary end is Saturday 07.11.2026. This assumes the period has already been correctly identified; it is not the answer where service during that interval triggers monthly notice. Posting a letter and the other party becoming able to read it can also happen on different dates.
After notice, the parties may agree an earlier end without changing the termination method itself. Distinguish this from an original mutual-termination agreement. Separately, legislation allows an employer to shorten three months in specified circumstances with the corresponding compensation. A spoken “you need not come tomorrow” is not automatically a document changing the contract’s end date.

How to deliver your notice
- Check the parties, contract date, applicable period and expected last day. If uncertain, request HR’s service calculation and retain your own records.
- Prepare a clear unilateral declaration rather than a request for permission. Include identification, contract, notice and signature.
- Deliver to an authorised recipient. Ask for the receipt date on your copy, not approval of your personal motives.
- For post, retain dispatch and delivery evidence. A letter merely posted on the last day of a month has not necessarily reached the employer.
- Agree leave, release from work, equipment handover and document contact details in writing. These are separate from the validity of notice.
- Check settlement and the employment certificate after the end. Retain lawful personal copies outside the work account.
The law requires writing. A signed paper original and a document with a qualified electronic signature differ from an ordinary messenger text. Email or a scan can cause disputes about form, content and receipt; speed alone is not a good reason to choose them when reliable written delivery is possible.
If receipt is refused, record the circumstances and use a provable channel. You do not need to force a manager to approve your decision. Equally, a colleague’s “I will pass it on” does not always establish delivery to the employer. Opportunity to read and the recipient’s authority can become key facts.
If the employer hands you a document
Read what it is: notice, mutual agreement or immediate termination. Ask for a copy and record actual delivery. If signing only for receipt, the wording should reflect that rather than simultaneously accepting an agreement. It is unsafe to sign everything unread merely to obtain wages.
For ordinary notice of a fixed-term or indefinite-term contract, the employer must state the justifying reason and information about appeal to the labour court. The reason must allow the actual basis to be understood, not be an empty formula. Union representation and particular protected groups involve additional procedures that cannot be replaced by a manager’s verbal assurance.
Refusing to sign does not necessarily prevent dismissal. A formally defective oral or electronic employer declaration should not be ignored as non-existent either. Lawfulness and remedies are separate questions, while the appeal clock may already be running. The official termination explanation helps distinguish the document, its defect and a court claim.
L4, leave and pregnancy: protection has limits
During leave or other justified absence, an employer generally cannot give ordinary notice while the relevant protected period continues. Sick leave beginning after notice was already served does not itself extend the contract. An employee can submit their own notice; protection against the employer is not a ban on resigning.
Long illness can permit separate non-fault termination under Article 53. For service below 6 months, the statutory threshold is illness lasting longer than 3 months; with at least 6 months or an occupational accident/disease, the relevant sickness pay and benefit period plus the first 3 months of rehabilitation benefit applies. This is not a universal “disciplinary dismissal for L4”. Check the actual basis, periods and exceptions rather than counting certificates.
Serious misconduct, bankruptcy and liquidation must also be distinguished from ordinary redundancy. Pregnancy, parenthood-related leave and pre-retirement protection have their own conditions and exceptions. Neither absolute immunity nor dismissal of anyone after a single absence can be promised. Our L4 guide explains insurance payments separately; it does not decide an individual dismissal.
Work, annual leave and release during notice
The contract continues until its end date. The employer may release you from work through the end of notice with pay preserved. Obtain clear confirmation of the days covered. Release is not annual leave: ask separately which days are deducted as urlop wypoczynkowy.
During notice, the employer may grant due annual leave, including the established balance, and the employee must take it under the rules. A remaining balance does not let you declare the last week off yourself. Nor can payment in cash simply be demanded in place of lawful leave while the employment continues.
If the employer gave notice lasting at least two weeks, an application can secure paid job-search leave: 2 working days for two-week or monthly notice, and 3 for three months, including statutory shortening. This is not ordinary annual leave; unused job-search days do not become a cash equivalent. The rule does not automatically apply to your own resignation.
Unused leave: establish hours before money
At termination, unused due annual leave normally becomes a cash equivalent, ekwiwalent. An exception can apply if both sides agree to use it under the next employment contract with the same employer beginning immediately afterwards. The employer cannot erase the balance merely because termination was disciplinary.
Request the current-year entitlement, earlier balance and actual leave used. Ordinary full-year entitlements are 20 or 26 days according to qualifying service; termination during the year, part-time work and first employment have particular rules. New 2026 service rules may change leave entitlement where earlier activity is properly evidenced.
Hypothetically, an employee entitled to 26 days worked from January through October. Under the assumed conditions, proportional entitlement is 26 × 10 / 12, rounded as prescribed to 22 days. With 18 used, 4 remain, or 32 hours under an ordinary eight-hour standard. If HR’s correctly calculated hourly equivalent is 40 PLN, the example gives 32 × 40 = 1280 PLN gross. This is neither a universal rate nor an amount promised to everyone.
The basis and coefficient follow specific rules, including fixed and applicable variable components. Do not divide any final salary automatically by that month’s working days. Ask for the base, coefficient, hours and deductions so that a discrepancy can be checked line by line.
The equivalent-payment deadline changed in 2026
Since 27.01.2026, Article 171 expressly ties the equivalent to the established payday. Generally, payment follows the wage-payment date under Article 85. If that date falls before termination, a separate 10-day period from termination applies. When the resulting deadline is a non-working day, payment is due on the preceding day.
PIP explains this new rule separately. The old assertion that all leave money must always arrive on the last day is therefore inaccurate. Equally, “sometime with the next bonus” does not satisfy a statutory deadline. Record the termination date, normal payday and actual due date.

Final settlement is more than one “everything paid” line
| Item | What to check | Do not confuse with |
|---|---|---|
| Wages | Time worked, ordinary due date and gross/net calculation | Unused-leave equivalent |
| Bonuses and overtime | Contract, bonus rules, rota and evidenced hours | Any orally mentioned bonus |
| Leave equivalent | Due balance, base, coefficient, hours and new deadline | Unused job-search days |
| Deductions | Legal grounds, limits and any required consent | An arbitrary resignation penalty |
| Severance | Legal basis, employer size and qualifying service | A mandatory payment for everyone leaving |
| Equipment | Handover record and complete items returned | A right to withhold all wages without grounds |
Earned wages do not disappear because you resigned. The contract’s end does not always mean ordinary monthly wages for a partial month must arrive that same day: check the established date and components. For bonuses, establish whether binding conditions were met or the payment genuinely is discretionary. Its label alone does not decide the dispute.
Check overtime, night hours, agreed expenses and advances already paid. Leave equivalent, wages and possible severance have different bases; net payment depends on applicable contributions and tax. “We will deduct everything for work clothes” does not replace lawful deduction rules, protected amounts and required written consent.
Return equipment against a record: device, charger, pass and other actually issued items. Agree task handover separately. Do not acknowledge damage you know did not occur merely to obtain a certificate, and do not delete work data yourself. Retaining personal wage evidence is not permission to take the customer database.
When severance is due, and when it is not
Severance under the non-employee-related termination statute depends on specific grounds, not every foreign employee’s departure. It covers employers with at least 20 employees; individual termination must satisfy the statutory exclusive-reason condition. Mutual agreement in qualifying circumstances can also require an entitlement check.
Under Articles 8 and 10 of the special Act, the amounts are one month’s pay for service below 2 years, two months for 2–8 years, and three above 8 years. The maximum is 15 minimum wages applicable on the termination date. This is a separate calculation, not fifteen salaries promised to everyone.
Resigning for another job, ordinary expiry and working for a small company do not themselves create that entitlement. Further payments may arise from a contract, collective arrangements or another special basis. Ask which payment and rule apply rather than treating every “compensation” as the same thing.
Świadectwo pracy: obtain, check and correct it
The employment certificate is due on termination if the employer does not intend to establish another employment relationship within 7 days. Where objective obstacles prevent immediate issue, delivery within 7 days is provided for. If another contract continues employment under the relevant rules, issue on request applies. The document cannot become security for returning a laptop or signing a disputed settlement.
Check periods, positions, working time, termination basis, annual leave used and information affecting rights with the next employer. This is not a reference or a place for arbitrary character assessments. Wrong dates or leave figures can affect later calculations even after money arrives.
You have 14 days from receipt to request correction from the employer. Following notification of refusal, the next court deadline is 14 days. If refusal is not notified, a court request is provided for; do not automatically invent the same starting date. See the focused employment-certificate guide.
After the last shift: residence and work permission are separate
Check the residence decision and work-authorising document, not just the card. Permanent residence, family grounds, temporary protection, an ordinary combined permit and Blue Card cannot be reduced to one deadline. Lawful stay and permission to work for the next employer are separate. See the definitions of a residence card and work permit.
For an ordinary temporary residence and work permit, the employee must notify the issuing voivode in writing within 15 working days of losing work with a listed employer. If the Head of UdSC issued the permit on appeal, notification still goes to the relevant first-instance voivode. In the specified case, a timely permit-amendment application fulfils the notification duty.
The employer has a separate 15-day notification duty: it does not replace your own 15 working days. Current Article 121 of the Foreigners Act states these separately. Retain transmission evidence and the precise job-loss date rather than merely an accountant’s promise.
Article 123 provides limited protection against withdrawal of the ordinary permit for 30 days if notification conditions are met; where all listed employment is lost, it applies no more than once during permit validity. This is not a universal job-search visa or permission to start any activity. Special categories have different rules. Establish the legal basis of the new job using our lawful-employment checklist, rather than expecting permission to follow the employment certificate automatically.
Challenging dismissal: do not wait a month for PIP first
An appeal against notice goes to the labour court within 21 days of service. The corresponding 21-day deadline also applies to reinstatement or compensation following termination without notice. It does not restart after the last shift, the certificate or HR’s response. Seek legal help promptly if the reason or protection is disputed.
PIP can inspect employment-rights and payment issues but does not replace the court’s ruling on unlawful dismissal, reinstatement or disputed compensation. An inspection complaint does not automatically suspend the court deadline. Our unpaid-wages checklist covers evidence and complaints; do not confuse it with challenging the termination itself.
Collect contracts, the document and service date, service calculation, rota, payslips and relevant correspondence. A court claim needs a specific remedy and defendant, not only a request to punish a company. If a deadline was missed without your fault, restoration is possible under statutory conditions with prompt action after the obstacle ends; it is not a guaranteed extension on request.
Six practical situations
These hypothetical examples show the checks, not the outcome of an individual court case.
A new employer is waiting, but notice is one month
The employee serves ordinary notice on 22.10.2026 and plans to finish on 30.11.2026. For an earlier exit, they propose a separately agreed date. They do not promise to start tomorrow merely because the old manager seems not to mind.
The service threshold is only days away
Do not select two weeks from service on the morning of notice. Check whether the threshold is reached during the expected period and qualifying earlier activity with the same employer under the 2026 rules. Request the calculation before fixing the new start.
L4 begins during notice
Separate previously served notice from new sick leave. Do not assume the end date moves automatically. Check insurance benefits and sickness obligations; for a separate new termination, establish its actual basis and protection.
An agreement is offered instead of notice
Read before signing and decide whether the date and terms are acceptable. Do not mistake porozumienie for a receipt. If already signed under pressure, preserve evidence and obtain help quickly rather than relying on a universal cancellation period.
Leave money was not paid on the final day
Check the balance, ordinary payday and new Article 171 rules. No money on the final shift does not by itself establish delay. Once the actual deadline passes, request the specific amount and calculation rather than accepting an indefinite promise.
An ordinary combined-permit holder loses the job
Record job loss, notify the proper voivode within your 15 working days and retain delivery evidence. Check new work permission separately. The employer’s promise to notify and the plastic card’s expiry date do not replace those steps.
A Polish sample for ordinary notice
Wypowiedzenie umowy o pracę: [miejscowość, data]. [imię i nazwisko pracownika, dane identyfikujące]. Do: [pracodawca]. Niniejszym wypowiadam umowę o pracę zawartą dnia [data] z zachowaniem obowiązującego okresu wypowiedzenia. Proszę o potwierdzenie otrzymania pisma oraz wskazanie daty rozwiązania umowy wynikającej z właściwego okresu wypowiedzenia. [podpis pracownika]. Potwierdzenie otrzymania: [data, podpis osoby upoważnionej].
Insert real details. This is ordinary unilateral notice, not mutual agreement or immediate termination under Article 55. Asking for the end date does not let the employer extend the lawful period arbitrarily. An earlier agreed exit needs appropriate separate wording, not a discreetly altered signature beneath this sample.
Common mistakes
- Applying employment notice and leave to every zlecenie or B2B arrangement.
- Counting a month from any date to the same date next month.
- Ignoring newly evidenced 2026 service and thresholds reached during notice.
- Signing mutual agreement as though merely acknowledging a letter.
- Taking leave or stopping work unilaterally after giving notice.
- Promising everyone severance and complete settlement on the last day.
- Waiting for PIP before challenging dismissal in court.
- Giving the employer your only copies of evidence.
- Treating a valid card as permission for any next job.
FAQ
Must the employer agree to my notice?
No. Ordinary properly delivered notice is unilateral. It does not release you from work before the end without a separate basis.
Is fixed-term notice always two weeks?
No. Fixed and indefinite terms use qualifying employer-service thresholds; probation is assessed separately.
Can I leave on the day I give notice?
By agreement or on a specific statutory ground for immediate termination. Ordinary notice alone does not allow it.
Must I explain why I am resigning?
Not for ordinary employee notice. Immediate termination requires a different assessment and stated grounds.
Does email make termination non-existent?
Not necessarily. Form, content and delivery can be disputed; ignoring a defective employer declaration instead of seeking timely protection is particularly risky.
Does L4 always extend the contract?
No. Sickness after notice was already delivered does not itself postpone the end. Protected regimes and separate grounds require their own checks.
Can the employer require leave during notice?
Yes, due leave can be granted under the rules. A balance does not let you choose absence unilaterally.
Is unused leave paid on the last day?
Since 27.01.2026, timing follows the ordinary payday; if it precedes termination, a separate 10-day period and preceding-day rule apply for a non-working deadline.
Does everyone receive severance?
No. A statutory or contractual basis is needed; the relevant Act requires at least 20 employees and qualifying grounds/service, not simply departure.
Can the certificate be withheld until I return a laptop?
Issue should not be made conditional on that settlement. Equipment return and lawful liability remain separate.
How long is there to correct the certificate?
14 days from receipt to the employer, then 14 days from notification of refusal to court. If refusal is not notified, the statutory court route applies.
Does a PIP complaint preserve the dismissal deadline?
No. Do not assume suspension of the 21-day period. Inspection and court proceedings address different questions.
Can earlier zlecenie count in 2026?
Qualifying documented periods may count. Employer-specific service needs the appropriate connection; transition and overlapping periods matter.
Does a new job automatically use the old permit?
No. Stay and work permission are separate. An ordinary combined permit has its own voivode notification duty, which does not authorise any new job.
Checklist before the last shift
Check contract, termination method and actual delivery. Retain the service calculation under applicable 2026 rules and the end date. Separate work, leave and paid release. Obtain itemised wages, bonuses, leave equivalent, deductions and any severance. Return equipment against a record, obtain the certificate and request correction promptly. Record court deadlines immediately and, for residence, your own voivode duty and the next job’s legal basis.
This guide uses the current Labour Code, PIP materials and the separately linked special Acts. New rules do not turn every civil contract into employment or guarantee a dispute’s outcome. Next scheduled check: 22.11.2026; legislative change or an individual decision requires earlier review.
